* Covered Works: This policy applies to all original compositions, sound recordings, stems, and artworks released publicly under the alias trung-nova, including independent releases and those distributed through doujin circles or record labels.
* Exceptions for Exclusive Works: These terms do not apply to exclusive tracks (e.g., private commissions where full rights were transferred to a third party).
* Collaborations and Label Releases: If a track features other producers/vocalists or was published by a label/circle, you must obtain written permission from both me and the other respective copyright holders.
* Third-Party Remixes: If I have remixed a track by another artist or from a video game, you must consult the original creator's or publisher's usage guidelines. I cannot grant permission for intellectual property that I do not own.[2. Permitted Uses (No Prior Permission Required)]
You may use my music in the following ways without contacting me first, provided you adhere to the specific conditions attached to each:A. Rhythm Games & Community Content
* You may use my songs to create unofficial, user-generated beatmaps or custom charts in games that support them (e.g., osu!, A Dance of Fire and Ice, Clone Hero).
* Condition: The resulting chart, level, and included audio file must be distributed to the gaming community completely [for free]. They cannot be locked behind a paywall, Patreon tier, or subscription, etc.B. Video Creation & Content Platforms (YouTube, Twitch, etc.)
* You may use my music as background music (BGM) in your videos or livestreams, regardless of whether your channel is monetized.
* Content ID Notice: My tracks may be registered in YouTube’s Content ID system. If you upload a video containing my music, you may receive a copyright claim. This is not a copyright strike.C. Transformative Remixes
* You are highly encouraged to create your own remixes of my songs, subject to strict distribution rules:
* Approved Platforms: You may only upload your remixes to YouTube and SoundCloud.
* Free Access: The audio file must be freely downloadable. If you choose to host it on Bandcamp, the price must be set exactly to $0.00 or "Name Your Price" with no mandatory minimum payment.[3. Prohibited Uses (Strictly Forbidden)]
The following activities are strictly prohibited. Engaging in them will result in an immediate DMCA takedown notice or further action:A. Theft and Plagiarism
* You may not never re-upload my original, unmodified audio files anywhere and claim them as your own work.B. Restricted Thematic Contexts
* My music may not be used in connection with:
* Illegal activities or content that violates public order and morals.
* Political campaigns, lobbying, or propaganda.
* Religious institutions or messaging.
* Content designed to promote hate speech, disparage, harass, or offend myself or any third party.C. Non-Transformative Edits on Commercial Streaming
* You may not take my songs, apply minor edits (such as "Sped Up," "Nightcore," "Slowed + Reverb," or simple re-mastering/re-arranging), and distribute them to commercial streaming services like Spotify, Apple Music, Tidal, or Amazon Music.
* Edits of this nature are only allowed on YouTube and SoundCloud, and they must have monetization turned off.D. Blockchain, NFTs, and Artificial Intelligence
* NFTs: You may not mint, sell, or associate my music (or its accompanying artwork) with Non-Fungible Tokens or any cryptocurrency project.
* Generative AI: You may not use my music, raw audio stems, or artwork to train, test, or develop Artificial Intelligence, machine learning models, or voice-cloning software, regardless of whether the output is for commercial or non-commercial use.[4. Commercial Licensing & Paid Commissions]A. The "Free Access" Rule for Derivatives
All derivative or transformative works (such as fan animations, music videos, or remixes) created using my music must be accessible to the public for free.B. Paid Derivative Commissions
If you are paying a third-party creator to make something that utilizes my music (for example: commissioning an animator to create a PV using my song, or paying a producer to remix my track), this is considered monetizing my original work.
* Mandatory Pre-Approval: You must contact me via email to discuss the project and receive written approval before any work begins or money changes hands.
* Failure to secure permission for paid commissions will result in a takedown notice against the final published project upon detection.C. Corporate, Institutional, and Official Use
* Organizations: If you represent a corporation, registered company, educational institution, or a volunteer organization, you must contact me beforehand to confirm usage rights.
* Official Software/Game Integration: If you wish to use my music as an official, built-in soundtrack (BGM) for a video game, software, or mobile app, you must contact me to confirm the licensing of my music.[5. Disclaimer of Liability]
You use my music entirely at your own risk. trung-nova assumes no responsibility or liability for any damages, legal disputes, copyright flags, or issues caused by your authorized or unauthorized use of the music.
